NOTICE OF CONFIRMATION OF AN ORDER PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER HIGHWAYS ACT 1980, WILDLIFE AND COUNTRYSIDE ACT 1981
The Oxfordshire County Council, Ardley Footpath No.1 (part), Public Path Diversion and Definitive Map and Statement Modification Order 2019
On 18th February 2020, the Oxfordshire County Council confirmed the above Order, made on 12th December 2019, under section 119 of the Highways Act 1980 and section 53A(2) of the Wildlife and Countryside Act 1981. The effect of the Order as confirmed is to modify the Definitive Map and Statement for the area by diverting 729m of Ardley Fp 1 running from the Fritwell-Brackley Road at the entrance to Green Farm at OS Grid Reference SP 5350 3000 south-eastwards to SP 5365 2989, south-south-westwards to SP 5363 2978 beside the Green Farm industrial units, westwards for approximately 32m through the farm to SP 5359 2978, generally southwards to SP 5357 2954 at the base of the M40 embankment, south-westwards parallel with the M40 to SP 5364 2950 and north-eastwards to SP 5369 2952 to a line running for 672m from the Fritwell-Brackley Road north east of the entrance to Green Farm at SP 5349 3001, south-eastwards to SP 5830 2981 and south-south-westwards to SP 5369 2952 where it re-joins the existing path as shown on the Order map. Oxfordshire County Council, Countryside Records, County Hall, New Road, Oxford OX11ND at the price of £3.50 per copy The Order came into force on the date of confirmation but if any person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 (the Act), as amended, and/or the powers of section 53A of the Wildlife and Countryside Act 1981 (WCA) or on the ground that any requirement of either Act or of any regulation made under them has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act and as applied by s53A(7) WCA, within six weeks from 27th February 2020 make an application to the High Court.
