NOTICE OF CONFIRMATION OF AN ORDER PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER HIGHWAYS ACT 1980, WILDLIFE AND COUNTRYSIDE ACT 1981

17a (part) and Crowmarsh Footpath 43 (part), Public Path Diversion and Definitive Map and Statement Modification Order 2019

On 25th February 2020, the Oxfordshire County Council confirmed the above Order, made on 20th September 2019, under section 119 of the Highways Act 1980 and section 53A(2) of the Wildlife and Countryside Act 1981. The effect of the Order as confirmed is to modify the Definitive Map and Statement for the area by diverting 16m of Crowmarsh BR 17a running from OS Grid Ref SU 61626 87476 south-south-eastwards for approximately 16m to SU 61631 87461 to a new line running for 20m from SU 61626 87476 running southwards for approximately 20m and then south-eastwards for approximately 4m to SU 61631 87461 to re-join the existing bridleway and by diverting 159m of Crowmarsh FP 43 running from OS Grid Reference SU 6147 8756 generally eastwards through the curtilage of Mongewell Park Farm to the Wallingford Road at SU 6162 8754 to a new line running for 165m from OS Grid Ref SU 6147 8756 east-south-eastwards to SU 6160 8750 and then south-south-eastwards for to the Wallingford Road at SU 6162 8748 opposite Crowmarsh BR 17a as shown on the Order map. Oxfordshire County Council, Countryside Records, County Hall, New Road, Oxford OX11ND at the price of £3.50 per copy The Order came into force on the date of confirmation but if any person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 (the Act), as amended, and/or the powers of section 53A of the Wildlife and Countryside Act 1981 (WCA) or on the ground that any requirement of either Act or of any regulation made under them has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act and as applied by s53A(7) WCA, within six weeks from 12th March 2020 make an application to the High Court.
