“IT’S not my belief that if you kiss someone that they're allowed to do anything they want,” said a woman who accused an Oxford chef of rape.
The woman, who cannot be named for legal reasons, was speaking at the trial of Heliton Barboza, who was a chef at The Ivy Oxford Brasserie.
It is alleged that the 25-year-old, who had finished his last shift at the restaurant, went for a drink with the woman before allegedly raping her on December 15, 2021.

Barboza, who had handed in his notice so he could go back to Brazil for Christmas, denies the allegation and states the pair had consensual sex.
During the trial on Wednesday (December 6), the woman told the jury that she and Barboza had kissed when they were at the Half Moon pub in St Clement’s Street.
However, she did not believe this gave him consent for further sexual activity.
When asked by defence barrister Surinder Gohlan how many times the pair kissed, the woman said: “I’m not sure, I don’t remember. I don’t remember who initiated it.
"But me kissing him didn’t give him consent to do anything to me afterwards.
“I remember a very, very small part of this part of the evening.
"It’s not my belief that if you kiss someone that they are allowed to do anything they want.”

Mr Gohlan said: “I’m not inferring anything. I’m just asking how many times you kissed him?”
“I’m sorry,” she responded.
“I’m being defensive but again, I don’t remember anything from this time. I just remember that we kissed and I didn’t feel good about it.”
When asked if the kiss was consensual, the woman said: “Yes, absolutely.”

However, the court heard the woman had then texted her mother saying she had ‘messed up’ which the woman believes was in connection to the kiss as Barboza was married.
Mr Gohlan, continuing his cross-examination of the woman, asked if she believed she was flirting with Barboza as she watched back the CCTV footage of the pub.
“I can’t remember,” she said. “I’m not a body language expert. I noticed I flicked my hair a few times but that’s what I do anyway.
“I probably was. I was just drunk flirting. I didn’t want it to extend to anything. I didn’t want to go home with anyone.
